What's The Difference Between A Divorce & an Annulment?

Divorce dissolves a valid marriage. An annulment voids an invalid marriage (as if the marriage never happened).

No Nevada Residency Requirement For An Annulment

Anyone who was married in Nevada can file for an annulment in Nevada; neither person has to be a Nevada resident (a Nevada resident can also file for an annulment here regardless of where the marriage took place).

A Nevada divorce, on the other hand, can only be granted to a Nevada resident.

Grounds

Divorce can be granted because of incompatibility.

The reasons for an annulment are:

  • Spouses are closer than 2nd cousins
  • One person was already married
  • 17 year old married without parental consent (with a couple of limitations)
  • Want of Understanding
  • Fraud
